Reopening a Bankruptcy Case

However, because we are all human, it is always possible for something to get overlooked or for an error to occur.

What can you do if you discover a mistake after your bankruptcy case has been closed? The law provides you with a procedure for reopening your case to cure an error. Examples of the type of mistakes you can reopen a case to fix include:

 

  • failure to list a creditor
  • failure to file the certification that you took the personal financial management course
  • failure to have a judgment lien removed from real estate
  • failure to list an asset or personal property

It is important to understand that requests to reopen a bankruptcy case are not guaranteed to be granted. So again, it is essential that you review your initial filings to verify they are correct. However, if you discover a mistake in a concluded case, we can help you try to get it fixed.
